1. Agreement

These Terms of Service (“Terms”) are an agreement between you and MarketChoice (marketchoice.app) (“MarketChoice”, “we” or “us”). They apply to our website, apps and related services, together called the “Platform”. Our Privacy Policy and MarketChoice Protected terms form part of this agreement. By creating an account, checking “I agree” or using the Platform, you accept these Terms. If you disagree, please do not use MarketChoice.

2. What MarketChoice is

MarketChoice is a local online marketplace where people can post and find nearby jobs, services and products. We offer listing and messaging tools and, where available, checkout through Stripe Connect. We are an intermediary, not the employer of Helpers or providers. We do not do the work or supervise it day to day. The customer and Helper make their own agreement for each job through the Platform.

3. Eligibility and accounts

You must be 18 or older and legally able to enter a binding contract in your province or territory. Give us accurate account information and keep your password secure. You are responsible for activity on your account. We may refuse, suspend or close accounts where needed to address safety concerns, fraud or breaches of these Terms.

4. Listings, jobs, and messaging

You are responsible for the listings, job posts, offers, messages, photos and reviews you share. They must be lawful, accurate and respectful. Do not spam, harass people or mislead them. We may remove content or restrict features. Information you choose to show on your public profile may be visible to other people.

5. Payments and fees

For new paid job bookings, Stripe charges the agreed CAD price when the customer books. Funds remain on the platform until the customer confirms completed work. MarketChoice then transfers 90% to the Helper’s connected account and retains a 10% platform fee, rounded to cents. Stripe processing fees reduce MarketChoice’s share. Transfer to a connected account is not a promise of immediate bank payout. This is a held-payment arrangement, not regulated escrow or insurance. Existing jobs already using approval-time payment retain that payment path.

The customer may cancel and receive a full booking refund before the Helper marks work started or submits completion. Once work starts, automatic cancellation refunds are unavailable; contact MarketChoice about an issue. You authorize electronic payments and receipts.

Off-platform payment, including cash, e-transfer outside MarketChoice checkout or Venmo, is discouraged and voids MarketChoice Protected.

6. MarketChoice Protected / Guarantee

MarketChoice Protected is a discretionary goodwill Guarantee, currently up to CAD $1,000 per eligible job fully paid through Stripe Connect on MarketChoice. It is NOT insurance and NOT a regulated insurance product. Personal insurance remains primary. Eligibility requirements and the 30-day review-request window apply, starting when payment is confirmed. Work or payment arranged off-platform voids Protected. We decide requests in our sole discretion; asking for a review does not guarantee a payment.

7. Helpers and providers (independent contractors)

If you earn through MarketChoice as a Helper or provider:

  • You run your own work or business as an independent contractor. You are not a MarketChoice employee, partner or agent.
  • You set or negotiate your rates within the available Platform tools, choose the opportunities you pursue and are free to work elsewhere.
  • You are responsible for your taxes, any applicable GST/HST/PST, CPP/EI obligations for your situation, invoices and records. MarketChoice does not withhold income tax as an employer.
  • You must have the licences, permits, insurance and certifications required for the services you offer. Customers should confirm the requirements for their particular job.
  • Stripe Connect handles payouts. You must complete Stripe’s identity and payout onboarding and comply with Stripe’s terms.
  • You confirm that you have the legal right to work in Canada for the services you offer.

8. Prohibited uses

Do not use MarketChoice for illegal goods or services, fraud, hate, harassment, sexual exploitation, or prohibited weapons or controlled substances. Do not impersonate others, scrape or interfere with the Platform, or take paid jobs off-platform after connecting here to avoid disclosed fees. We may investigate suspected misuse, remove content and close accounts.

9. Intellectual property

Our branding, software and Platform design belong to MarketChoice or our licensors. You retain ownership of your content. By posting it, you give us a worldwide, non-exclusive, royalty-free licence to host, display and use it to operate, improve and promote the Platform. Only upload content you have the right to share.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. To the fullest extent Alberta and Canadian law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise uninterrupted service or guarantee the quality, safety or legality of users’ listings or work. Using the Platform and dealing with other users involves risks you accept. These Terms do not limit consumer protection rights that the law does not allow us to limit.

11. Limitation of liability

To the fullest extent permitted by law, MarketChoice and its operators are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, connected with the Platform or user interactions. Our total liability for Platform-related claims is limited to the greater of CAD $100 or the platform fees you paid us during the three months before the claim. This does not exclude liability that cannot legally be excluded, including fraud or gross negligence where an exclusion would be void.

12. Indemnity

You agree to indemnify and hold MarketChoice harmless against claims, losses and expenses, including reasonable legal fees, arising from your content, Platform use, jobs or listings, or a breach of these Terms or the law. This does not apply to the extent the loss was caused by our gross negligence or wilful misconduct.

13. Suspension and termination

You may stop using MarketChoice and close your account. We may suspend or end access for breaches of these Terms, legal risks or threats to Platform integrity. Terms intended to continue after termination, including intellectual property, disclaimers, liability limits, indemnity and governing law, remain in effect.

14. Changes

We may update these Terms and post a new version with an updated date. For material changes, we will take reasonable steps to notify you, such as email or an in-app notice. Continuing to use the Platform after the effective date means you accept the changes, unless the law requires another process.

15. Governing law and disputes

Alberta law and the federal laws of Canada that apply in Alberta govern these Terms, without applying conflict-of-law rules. Subject to mandatory consumer rights in your province, Alberta courts have exclusive jurisdiction. Please contact us first so we can try to resolve concerns informally.
